Terms of Service
By using Pimetric you agree to these terms. They cover what we promise to deliver, how you may use our service, and the limits of our liability.
Acceptance of terms
These Terms of Service (“Terms”) form a binding agreement between you and Pimetric, Inc. (“Pimetric,” “we,” or “us”). By accessing or using the Pimetric website, dashboard, API, or any report generated by us (collectively, the “Service”), you accept these Terms. If you are agreeing on behalf of an organization, you represent that you have the authority to bind that organization.
Eligibility
You must be at least 18 years old and able to form a legally binding contract. The Service is currently available only in the United States. If you are an Operator (property manager, landlord, leasing agent), you must have a permissible purpose under the FCRA to obtain a consumer report on each applicant you submit.
The service
Pimetric generates affordability reports (“CashScores”) based on a read-only feed of bank-account data provided by the applicant through our regulated banking-data partner. A CashScore is a single-page report summarizing income, cash buffer, and risk flags across up to 24 months of bank activity.
We may add, modify, or remove features at any time. We will give reasonable notice of changes that materially reduce paid functionality.
Account responsibilities
- Keep your credentials confidential. You are responsible for activity under your account.
- Provide accurate, complete information when registering and keep it current.
- Do not share login access with anyone outside your organization.
- Notify us immediately at security@pimetric.com if you suspect unauthorized access.
Operator obligations under the FCRA
If you are an Operator using a report to take adverse action against an applicant — including denial, requiring a higher deposit, or requiring a co-signer — you must:
- Have a permissible purpose under 15 U.S.C. § 1681b before requesting any report.
- Provide the applicant with a written adverse-action notice that includes our name, address, and a statement that we did not make the decision.
- Provide the applicant a copy of the FTC's "A Summary of Your Rights Under the Fair Credit Reporting Act."
- Honor any dispute or correction request that is forwarded by Pimetric in connection with the applicant.
- Comply with all state-level rental screening laws applicable to the property.
You agree to indemnify Pimetric against any claim arising from your failure to meet these obligations.
Acceptable use
You agree not to:
- Request a report without a permissible purpose or applicant consent.
- Use the Service to discriminate on the basis of race, color, religion, sex, national origin, familial status, disability, source of income, or any other class protected by federal, state, or local law.
- Reverse engineer the Service, scrape the dashboard, or attempt to extract our underlying models.
- Resell, sublicense, or otherwise commercially exploit a report outside the original tenancy decision.
- Interfere with the integrity, performance, or security of the Service.
Fees and billing
Reports are billed per completion. A report is “completed” when the applicant successfully connects an account and we generate a CashScore. Abandoned applications are not billed. Volume tiers adjust automatically based on your monthly usage as published on pimetric.com/#pricing.
Fees are charged in U.S. dollars and are exclusive of taxes. Failure to pay an invoice within 30 days may result in suspension of the Service. Fees already paid are non-refundable except where required by law.
Termination
You may terminate your account at any time from the dashboard or by emailing hello@pimetric.com. We may suspend or terminate your access immediately for material breach of these Terms or for activity that puts applicants, our systems, or the integrity of the Service at risk. Sections that by their nature should survive termination — including indemnity, fees owed, disclaimers, and limitations of liability — survive.
Intellectual property
Pimetric retains all right, title, and interest in the Service, including software, models, scoring methodology, designs, and documentation. You receive a non-exclusive, non-transferable license to use the Service during your subscription. Reports generated about a specific applicant may be retained by Operators for their internal decision record but not redistributed.
Disclaimers
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Pimetric disclaims all warranties — express, implied, or statutory — including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any specific applicant will be approved or denied. The CashScore is a decision-support tool. Final tenancy decisions are made by the Operator, not by Pimetric.
Limitation of liability
To the maximum extent permitted by law, Pimetric's aggregate liability arising out of or relating to these Terms or the Service is limited to the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) one hundred U.S. dollars ($100). In no event will we be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data — even if we have been advised of the possibility.
Indemnification
You agree to defend and indemnify Pimetric against any third-party claim arising from (a) your breach of these Terms, (b) your misuse of a report, (c) your violation of any law including the FCRA or fair-housing law, or (d) your violation of any third-party right.
Governing law and disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. Any dispute that cannot be resolved informally will be brought exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to personal jurisdiction there.
Changes to these terms
We may update these Terms when our service or the law changes. Material changes will be communicated by email and posted here at least 30 days before they take effect. Continued use of the Service after the effective date means you accept the revised Terms.
